LA DA Office Issues Statement While Waiting on Marilyn Manson Case

The Los Angeles district attorney provided an update on the Marilyn Manson case via their Instagram account today. A question from Marilyn Manson Uncanceled which said “Evan Rachel Wood wanted me to ask how the Brian Warner case is developing?” prompted the response.

The DA, George Gascón stated on Marilyn Manson (who’s real name is Brian Warner) “The Brian Warner matter is still under investigation by the Los Angeles County Sheriff’s Department and has not yet been submitted to our office. Please be assured that we are requesting regular updates on the status of the investigation.

The District Attorney is committed to investing in trauma-informed care for all victims of sexual assault, abuse and intimate partner violence. We understand how difficult it may be to come forward as a victim, especially when the case involves this level of notoriety, and are dedicated to treating all victims with the highest levels of care and respect.

Once we have received the case, it will be carefully evaluated by an experienced prosecutor to determine if it is appropriate to file charges at this time. We are hopeful that the LASD will present the case to us sometime this month.”

Despite what the Huffington Post said on this, Gascón makes no indication either way towards Warner’s innocence or guilt. He clearly made a point to stay neutral and assure everyone they are looking into it, while acting sympathetic towards “alleged victims”. Which we agree they should approach accusations like this carefully.

All he said is they are “hopeful that the LASD will present the case to us sometime this month.” Nowhere in here does he say “We are hopeful to nail Manson soon”. If anyone interprets the message like that has no understanding of basic law.

This is reminiscent of the attempts at creating a criminal case against Andrew Cuomo, the former Governor of New York. The Sheriff of Albany, NY, Craig Apple, made a public announcement that he was going to formerly charge Cuomo, only to have his plans completely derailed by the DA because his actions against Cuomo had no legal standing.

Will the county DA ever see the case against Warner come across their desk? If it does will it even go anywhere? History says it will fall flat.
